1. The participant is entitled to visit the art offerings of the AKTHOF Studio School of Art in the respective premises. Failure to attend does not entitle you to reduce, reduce or reclaim the booking fee. This does not affect the extraordinary termination for good cause.
2. The participant must comply with the AKTHOF's house rules. In case of non-compliance, AKTHOF is entitled to terminate the contract without notice. Apart from legal requirements, no liability is assumed for the loss of valuables or accidents.
The participant must follow the instructions of the teaching staff and handle the material provided and the equipment of the respective venue with care.
3. Registration, conclusion of contract and course fees
3.1 Course attendance is only possible after prior registration.
This does not apply to evening classes. Their visit can take place without prior notice.
3.2 The course fee is based on the respective course description on the website www.akthof.de.
It can be paid in cash or by bank transfer. Prices exclude material costs and model money.
3.3 Registration takes place in person, by post, by fax or online by submitting a fully completed registration form.
A deposit of 25, - € is required upon registration. After receipt of the down payment of 25, - €, the course participant will receive a confirmation of registration from AKTHOF. The contract is thus concluded and the place in the booked course is bindingly reserved.
3.4 The full balance of the course fee must be paid up to 14 days before the start of the booked course. If the course fee has not been received in full by then, AKTHOF reserves the right to withdraw from the contract and reallocate the reserved place. In this case, the deposit already paid will be withheld, with the customer being able to prove no or significantly lower damage.
Remaining places can be allocated 14 days before the start of the course. In this case, the full course fee is due upon registration. Registration will be confirmed in full upon receipt of the course fee.
In case of doubt, course places will be allocated in full according to the order in which payment of the course fee is received. If participation is no longer possible due to overcrowding in the course, the customer will be informed immediately and payments already made will be refunded. The provision in section 3.4 paragraph 2 of the General Terms and Conditions remains unaffected.
When participating in evening courses, the full fee must be paid in cash at the start of the course, unless it has already been paid by paying a “10-hour pass” or a “4-week subscription.”
The “10-hour card” is valid for 2 years from the date of purchase; it is not possible to exchange or pay out remaining hours. The “10-hour pass” is not transferable.
The “4-week subscription” entitles you to attend evening lessons 3 days per calendar week during the selected validity period. The “4-week subscription” is not transferable.
4. Cancellation by the customer
The cancellation of a course registration must be made in writing. The date of cancellation is its receipt by AKTHOF.
If the written cancellation is received up to 15 days before the start of the course, the course fee will be refunded minus the deposit in accordance with section 3.3 paragraph 2 sentence 1 GTC. If the written cancellation is received from the 14th day before the start of the course or if you do not show up, no refund of the course fee is possible.
However, the customer always has the option to provide a replacement participant or to prove no or significantly less damage.
5. Up to 7 days before the start of the course, the right is reserved to cancel the course due to an insufficient number of participants or to postpone it to a later date.
If, for organizational reasons, the respective venue of the occupied AKTHOF art offering is moved to another location within a reasonable distance from the original location, this contract remains valid. In the event of a simple interruption of school operations of up to four weeks, e.g. due to illness of the teaching staff, this contract is suspended for the duration of the failure and is then made up for. If the contract cannot be fulfilled by AKTHOF for reasons that come from outside, are unforeseeable and cannot be averted by reasonably expected care, this does not result in any claims for compensation by the contractual partner against the AKTHOF Studio School of Art.
6. The legal representatives/contract partners agree to the storage and transfer of contract-related data by AKTHOF Studio School of Art. Only a necessary minimum of data is collected and information about the stored data can be provided at any time. The data is handled with great care and is not distributed/sold or made available to third parties for use outside of services for AKTHOF. The deletion of data after the agreed contract period can be requested in writing and will then be carried out.
7. Liability
Staying in the course rooms, taking part in the course and using tools and materials in any form is at your own risk. The respective perpetrator is liable for damage to the AKTHOF or damage to third parties. Damage to AKTHOF's property must be reported immediately.
AKTHOF is only liable for damages insofar as they are based on an intentional or grossly negligent breach of duty by AKTHOF, its legal representative or a vicarious agent. This limitation of liability does not apply to damage resulting from injury to life, limb or health.
8. Copyrights
The course materials given to the participant are protected by copyright. Duplication, transfer or other use - even in part - is only permitted with the express written consent of the AKTHOF.
9th The legal representatives/contract partners hereby give their consent that film and photo recordings may be distributed and published by AKTHOF without compensation — both for press purposes and on its own website. The recordings are published exclusively as part of AKTHOF activities, without limiting the spatial or temporal area of use, including for personal advertising purposes. The legal representatives/contract partners agree to the processing and retouching of the image and video recordings by AKTHOF, provided that this does not infringe personal rights.
10th Should a contract provision be or become invalid, this does not affect the other provisions and the validity of the contract. In this case, the invalid provision will be replaced by a provision that complies with legal standards.
Munich is defined as the place of jurisdiction. Any ancillary agreement must be made in writing.
